Tier 1 Entrepreneur extension requirements
Tier 1 Entrepreneur visa was closed on 28 March 2019. It is only open to people who are currently on Tier 1 Entrepreneur. Tier 1 Graduate Entrepreneur or on
Start up previous on Graduate Entrepreneur also can apply.
Immigration Rules for switching from Tier 1 Graduate Entrepreneur.
- You have to show you have an access of £50,000 or
- you have invested £50,000 into your own business or an existing business.
- You have a maintenance fund of £945 for consecutive 90 days.
- You have written a business plan which is credible and viable.
- You have to demonstrate you are a genuine entrepreneur.
The immigration rules for Start up previous on Graduate Entrepreneur to switching are the same.
You only can switch to Tier 1 Entrepreneur until 5th July 2021.
Immigration rules for Tier 1 Entrepreneur extension:
- You have invested £200,000 or £50,000 based on your initial application.
- You have been appointed as a director or
- registered self employed person within six months of your initial application was approved.
- You have created equivalently two full time jobs for 12 months.
- if your business has been interrupted by Covid pandemic, you don not need to employ at least 2 people for 12 months for Tier 1 Entrepreneur extension.
- The 12 month period employment can be made up of multiple jobs across different months. They must be the equivalent to 2 full time jobs when combined.
- You have a maintenance fund of £945 for consecutive 90 days.
- You have to demonstrate you are a genuine entrepreneur.
Tier 1 Entrepreneur extension will be closed from 5th April 2023.
Genuine test for Tier 1 Entrepreneur extension application
When you apply for Tier 1 Entrepreneur extension, you are subject to genuine test, the case worker will assess you that:
- have established, taken over or become a director of one or more genuine businesses in the UK, and have genuinely operated that business;
- have genuinely invested the money
- intend to continue operating one or more businesses in the UK; and
- do not intend to take employment other than under the terms of paragraph 245DE of the Immigration Rules.
They will assess
- the evidence you submit;
- the viability and credibility of the source of the money referred to in Table D: Extension Applications
- the credibility of the financial accounts of the business or businesses;
- the credibility of your business activity in the UK;
- the credibility of the job creation which you are claiming points;
- if the nature of the business requires mandatory accreditation, registration and/or insurance, whether that accreditation, registration and/or insurance has been obtained; and
- any other relevant information.

Requirements for Indefinite Leave to Remain via Tier 1 Entrepreneur
Immigration Rules for Tier 1 Entrepreneur to Indefinite Leave to Remain (ILR):
- You have invested £200,000 or £50,000 based on your initial application.
- You have created equivalent two full time jobs for 12 months after your extension.
- You have passed life in the UK test and English language test or your degree was taught in English if you are not from one of English speaking countries.
- You have stayed in the UK continuously for 5 years lawfully in the UK with leave as a Tier 1 Entrepreneur migrant,
- you have not been outside of the UK for more than 180 days absent each year or any 12 months if your recent application was submitted after 11 Jan 2018.
